In accordance with the provisions of Articles 6-III and 19 of Law no. 2004-575 of June 21, 2004 for Confidence in the Digital Economy, known as L.C.E.N., users and visitors, hereinafter referred to as the "User", to the site www.pinballcustom.com, hereinafter referred to as the "Site", are hereby informed of the present legal notice.

Connection to and browsing of the Site by the User implies full and unreserved acceptance of the present legal notice.

They are available on the Site under the heading "Legal information".

This website is published by AGENCE BOOM!, a French single-member limited liability company, with share capital of 5 000 €, registered with the Toulouse Trade and Companies Register under number 813 947 363. ARTICLE 2 - THE HOST

The Site is hosted by OVH, whose registered office is located at 2 rue Kellermann, 59100 Roubaix, France, with telephone number 1007 + contact e-mail address.

ARTICLE 3 - SITE ACCESS

The Site is accessible at all times, 7 days a week, 24 hours a day, except in the event of force majeure, scheduled or unscheduled interruption, or where maintenance is required.

In the event of modification, interruption or suspension of the Site, the Editor cannot be held responsible.

ARTICLE 4 - DATA COLLECTION

The Site ensures that the User's personal information is collected and processed with due respect for privacy, in accordance with the French Data Protection Act no. 78-17 of January 6, 1978.

Under the French Data Protection Act of January 6, 1978, the User has the right to access, rectify, delete and object to his or her personal data. The User may exercise this right :

Any use, reproduction, distribution, marketing or modification of all or part of the Site without the Publisher's authorization is prohibited and may result in legal action and prosecution as provided for in the French Intellectual Property Code and the French Civil Code.

Terms and conditions of sale

These terms govern sales between AGENCE BOOM!, a French single-member limited liability company with share capital of 5 000 €, Toulouse registration number 813 947 363, registered office at 167 chemin de la Bessoune, 31620 Villeneuve-lès-Bouloc, France, operating www.pinballcustom.com as Custom Pinball, and the consumer buyer. Mandatory consumer protection rules remain applicable.

Updated: 24/10/2026. This version applies to new orders. Earlier orders remain subject to the terms accepted when the contract was concluded, without prejudice to applicable statutory rights.

Article 1. Purpose

The present conditions of sale aim to define the contractual relations between Custom Pinball and the buyer, and the conditions applicable to all purchases made through the www.pinballcustom.com website. The acquisition of a product through the present site implies unreserved acceptance by the purchaser of the present conditions of sale, which the purchaser acknowledges having read prior to ordering.

Prior to any transaction, the buyer declares on the one hand that the purchase of products on the www.pinballcustom.com site is not directly related to his/her professional activity and is limited to strictly personal use, and on the other hand that he/she has full legal capacity, allowing him/her to commit to the present general sales conditions.

Pinball Custom reserves the right to modify these terms and conditions of sale at any time, in order to comply with any new regulations or in order to improve the use of its site. Consequently, the applicable conditions will be those in force at the date of the buyer's order.

Article 2. Products

Products are those shown on www.pinballcustom.com, subject to the availability stated. Each product page describes its essential features, materials, options, compatibility and any personalisation. Photographs illustrate the products; minor variations arising from handmade production cannot deprive the customer of agreed characteristics or statutory guarantees.

Handmade production or manufacture to order does not, by itself, remove the right of withdrawal. Only goods made to the consumer’s specifications or clearly personalised fall within the statutory exception described in Article 6. Selecting a standard catalogue option is not, by itself, sufficient to establish that exception.

Sales are available to countries permitting import of the relevant products, subject to the destinations offered at checkout.

Article 3. Rates

The prices appearing on the product sheets of the internet catalog are in Euros (€) and include all taxes (TTC), taking into account the VAT applicable on the day of the order. Any change in the VAT rate may be reflected in the price of the products.

Pinball Custom reserves the right to modify its prices at any time, it being understood however that the price appearing in the catalog on the day of the order will be the only one applicable to the buyer. The prices indicated do not include delivery charges, which are invoiced in addition to the price of the products purchased, according to the total amount of the order.

Article 4. Ordering and payment

The buyer selects products and options, checks the basket, contact and delivery details, shipping costs, total price and stated timeframes, then accepts these terms before placing an order with an obligation to pay. Available payment methods are those shown at checkout. Card details are entered through the payment provider’s secure interface.

Order confirmation is sent to the email address provided by the buyer. The applicable terms and the model withdrawal form are supplied on a durable medium with the contractual confirmation. Payment does not remove withdrawal rights, statutory guarantees or the right to challenge an unauthorised transaction with the payment service provider in accordance with the law. Article 5. Reservation of ownership

Pinball Custom retains full and complete ownership of the products sold until full payment has been received, in principal, fees and taxes included.

Article 6. Withdrawal

Statutory period: 14 calendar days, without giving a reason. For goods, this period starts the day after receipt by the customer or a nominated third party other than the carrier. For several goods delivered separately in one order, it starts after receipt of the last item. For services, it starts the day after the contract is concluded. If the last day is a Saturday, Sunday or public/non-working holiday, the deadline extends to the next working day.

Before the deadline, use Product returns / withdrawal, available without signing in from the footer, or send the model form below or any other unambiguous statement to pinballcustom@gmail.com or the postal address below. No prior approval from the workshop is needed to notify a valid withdrawal. The online process lets you review the details and confirm withdrawal; an email acknowledgment records its contents and submission date and time.

Return the goods without undue delay and within 14 days of notifying withdrawal to AGENCE BOOM! / Custom Pinball, 167 chemin de la Bessoune, 31620 Villeneuve-lès-Bouloc, France. The customer pays the direct cost of returning goods for withdrawal. There is no penalty or fixed restocking fee. Goods may be handled as in a shop to establish their nature, characteristics and functioning; the customer is liable only for diminished value caused by handling beyond those checks. Original packaging is recommended for protection, but is not a condition for exercising withdrawal.

For withdrawal from the whole order, we refund amounts paid, including standard initial delivery, without undue delay and within 14 days of notice. The extra cost of a more expensive delivery method chosen by the customer is not refundable. For goods, reimbursement may be withheld until their return or evidence of dispatch, whichever occurs first. The same payment method is used unless another method is expressly agreed at no cost.

Strictly statutory exceptions. Under Article L. 221-28 of the French Consumer Code, withdrawal is excluded in particular for goods made to the customer’s specifications or clearly personalised. Where applicable, this is disclosed before ordering; it does not automatically apply to every handmade item and never removes statutory guarantees. If a service starts during the 14-day period at the customer’s express request, only the proportionate amount for services actually provided may be due under Article L. 221-25. Loss of withdrawal rights for a fully performed service requires the consents prescribed by law.

Defect or incorrect delivery: this is not simply a change-of-mind return. Contact us with the order reference and a description of the problem; useful photos may help our assessment. The workshop examines the case and explains the next steps. Where a statutory guarantee applies, remedies and necessary return costs are free of charge to the customer. Assessment of the case or a reasoned disagreement does not restrict statutory rights or remedies.

Article 7. Shipping

Delivery is to the address supplied at checkout within the destinations offered. The available carrier, delivery method, cost and delivery date or timeframe are stated before payment. The workshop dispatch estimates above are separate from transit time and do not override the delivery commitment given at checkout. We inform the customer of difficulties or delay. If no date or timeframe has been agreed, delivery must take place within 30 days of concluding the contract.

If the agreed deadline is missed, the consumer may request delivery in writing within an additional reasonable period. If delivery still fails, the contract may be terminated. Immediate termination is possible if the seller refuses delivery or the agreed date was an essential condition made known before ordering. Amounts paid are then refunded within 14 days of termination under Articles L. 216-6 and L. 216-7 of the French Consumer Code.

When the carrier is offered by Custom Pinball, risk of loss or damage remains with us until physical possession passes to the consumer or their nominated third party. The statutory exception concerns only a carrier independently chosen by the consumer and not offered by the seller.

Tracking is provided where available. Check the parcel and goods upon receipt and promptly report damage to us, recording useful reservations with the carrier where possible. Failure to make reservations or a carrier claim within three days does not remove rights against the seller or statutory guarantees.

Article 8. Warranty

The seller responsible for statutory guarantees is AGENCE BOOM! / Custom Pinball, 167 chemin de la Bessoune, 31620 Villeneuve-lès-Bouloc, France; pinballcustom@gmail.com; +33 9 78 81 78 39. Contact us with proof of purchase and a description of the defect. No general 30-day claim limit replaces statutory periods. Assessment respects statutory presumptions and the burden of proof; guarantees are not conditional on discretionary approval.

Article 9. Liability

Custom Pinball is legally responsible for proper performance of its distance sales obligations, including those performed by a service provider. Statutory grounds for exemption remain applicable, including the consumer’s fault, an unforeseeable and insurmountable act of a third party to the contract, or force majeure. Nothing in these terms limits statutory guarantees or mandatory consumer rights.

Article 10. Intellectual property

All elements of the Pinball Custom site (site name, url, products) are and remain the exclusive intellectual property of Custom Pinball. No one is authorized to reproduce, exploit, or use for any purpose whatsoever, even partially, elements of the site whether in the form of photo, logo, visual or text.

Article 11. Personal data

Data needed for orders, guarantees and withdrawal requests is processed to perform the contract and comply with legal obligations. GDPR rights of access, rectification, erasure, restriction, objection and, where applicable, portability may be exercised through pinballcustom@gmail.com. Purposes, recipients, retention periods and how to complain to the CNIL are described in our privacy policy.

These terms are governed by French law, without depriving consumers of mandatory protection applicable in their country of habitual residence where the law provides. Jurisdiction is determined by the applicable legal rules; consumers are not required to bring proceedings exclusively before the courts of Toulouse.
